JIC RELEASE NO. 1040 -​ Governor Lou Leon Guerrero Signs Executive Order No. 2022-13; DPHSS Issues Guidance Memo 2022-12

On May 2, 2022, Governor Lou Leon Guerrero signed Executive Order No. 2022-13, relative to extending the public health emergency and rescinding the mask mandate, and also orders such that effective 12:01 a.m., Tuesday, May 3, 2022:

  • The mask mandate first imposed in Section 2(b) of Executive Order No. 2020-44, and most recently amended in Section 2 of Executive Order No. 2022-09, is hereby rescinded. Wearing masks in public settings shall be optional, subject to applicable Department of Public Health and Social Services (DPHSS) guidance.

 

Businesses may impose stricter restrictions, including requiring mask wearing and social distancing in their establishments, subject to local and federal law.

Executive Order 2022-13 also states that individuals are encouraged to continue to wear masks if they are immunocompromised, at high risk for severe illness, or if they prefer to do so. Individuals who are not vaccinated or boosted are at an increased risk of infection, hospitalization, and death as a result of COVID-19. Such individuals are encouraged to get vaccinated immediately, prior to engaging in activities in congregate settings in which mask use is compromised.

DPHSS Issues Guidance Memo 2022-12

On May 2, 2022, DPHSS issued DPHSS Guidance Memo 2022-12, relative to minimum requirements and recommendations for businesses, childcare facilities, and other entities in accordance with Executive Order 2022-13. DPHSS Guidance Memo 2022-12 rescinds DPHSS Guidance Memo 2022-11 Amendment 2, and states:

  • Congregations and social gatherings shall be permitted for both indoor and outdoor activities without numerical limitations, and individuals will no longer be required to wear masks in public settings
  • Stricter policies may be implemented by businesses or other entities, including, but not limited, to mask wearing, vaccination requirements, physical barriers, social distancing, and limited occupancy, subject to local and federal law

 

DPHSS Guidance Memo 2022-12 is subject to change in the event of an unanticipated deviation from the anticipated sustained reduction in local metrics.
