DPHSS Issues Guidance Memo 2021-19
Today, the Department of Public Health and Social Services (DPHSS) issued DPHSS Guidance Memo 2021-19, relative to vaccination requirements for establishments, activities, and organized sports, pursuant to Governor’s Executive Order No. 2021-19. The enforcement of these provisions will commence on Monday, September 6, 2021. 

 

DPHSS Guidance Memo 2021-19 supersedes all previous DPHSS guidance documents that are in effect, in whole or in part, including DPHSS Guidance Memo 2021-18, which contradict or conflict with, Executive Order 2021-19 and DPHSS Guidance Memo 2021-19. Face masks, contact logs, cleaning and disinfection of surfaces, and handwashing and respiratory etiquette must still be maintained. Contact logs shall include a list of each individual’s name, contact information (phone number and/or email), date, and time of visit. 

 

DPHSS Guidance Memo 2021-19 mandates that the following establishments and activities shall require all individuals, including staff, patrons, participants, and coaches, age twelve (12) and older to show proof that they are fully vaccinated to enter their facilities or premises:

 
  • Boat cruises;

  • Bowling alleys;

  • Concerts and similar events; 

  • Eating and Drinking Establishments with in-person, indoor/outdoor dining, except those in school building facilities;

  • Food courts at Shopping Centers or Malls;

  • Food service at funeral ceremony;

  • Gymnasiums, fitness centers, and dance studios;

  • Movie theaters;

  • Organized contact sports and competition;

  • Swimming pools;

  • Theaters and museums; and

  • other Covered Establishments determined by DPHSS

 

Covered Establishments listed above:

  • must verify the full vaccination of each individual prior to entry into the facility;

  • shall not accept written self-attestation as proof of full vaccination; and

  • are prohibited from serving any individual who fails to provide proof of full vaccination

 

Individuals who do not provide proof of full vaccination as by DPHSS Guidance Memo 2021-19 may not use indoor or outdoor portions of such facilities, except in the following situations, provided such individual wear a face mask properly:

 
  • To order, pick up, or pay for food or drink for take-out orders; and/or

  • To use a restroom

 

DPHSS Guidance Memo 2021-19 provides additional requirements and guidance for congregating, social gatherings, signage for patrons and staff at covered establishments, acceptable proof of full vaccination, and individuals seeking religious or medical exemptions.
